Nationally Certified Custody Evaluator (NCCE)
A Custody Evaluator is a Mental Health Professional
who makes a written recommendation to the Court
as to what Custody-Visitation arrangements
would be in the best interest of the children involved.
In a perfect world,
a "Custody Evaluation" would make everyone happy.
There is no such thing as a "perfect" world.
The very fact that a Custody Evaluation Study is needed
means people don't agree what is in the
"best interest of the child(ren)."
In the interest of objectivity, it is recommended that each party pay one-half the costs of the evaluation.
to avoid the appearance that the Evaluator may be biased toward the person paying the fee.
Children do not "BELONG" to anyone
there is NOTHING more unexplainable or unacceptable
than to watch people who no longer want to be "together"
make being "separate" a part of the child's past, present or future.
In most cases, your written and signed authorization is required before information concerning your care can be disclosed to individuals outside OUT OF THE TANGLED WEB. However, it is clearly understood PRIOR to the evaluation that the findings of the said evaluation are the property of the Court and/or the Individuals/Legal Representatives of said Individuals. Prior to beginning the evaluation, you will have signed Release Forms. There are Laws of Ethics that govern Professionals called HIPPA https://www.hhs.gov/hipaa/for-professionals/index.html
Below are some of the cases in which the law dictates that your signed authorization may not be required in order for Out of the Tangled Web to release information:
If it is believed that you are likely to harm yourself and/or another person, an action deemed necessary will be taken to protect you or others by contacting law enforcement officers or a physician.
If there is cause to believe that a child has been or may be abused or neglected, the Evaluator is required to make a report to the appropriate state agency.
If there is cause to believe that an elderly or disabled person has been or may be abused, neglected, or subject to financial exploitation, the Evaluator is required to make a report to the appropriate state agency.
Information disclosed about any person behaving toward you in a sexually inappropriate manner must be reported (your identity may remain anonymous at your request).
If your records are requested by a valid subpoena or court order, we must respond. in this case, again, it is understood that NO subpoena or court order is required as the evaluation is the property of the Court, both individuals and/or the Legal Representation of either party. If you are NOT LEGALLY represented, it is a strong recommendation of OUT OF THE TANGLED WEB that you retain and/or consult the proper representation.
If you are a minor (under the age of 18).
Custody Evaluations are most often utilized in highly contested Custody Disputes.

In the course of an investigation,
a Custody Evaluator will interview both parents,
observe the child(ren) with each of the parents,
have "age-appropriate" interviews with the child(ren),
and interview other significant people in the child(ren"'s lives.
It may be helpful to visit the child(ren)'s home
or any place where they may be living.
A Custody Evaluation contains a summary of the information collected,
an assessment of the family and the needs of the child(ren).
It will usually include a recommendation for the legal, physical custody and the custody/visitation agreement.
